Community Right to Buy: Some Facts

Here is a summary of the pertinent facts relating to Community Rights to Buy:

  • A community right to buy gives the community the time to decide whether to purchase an asset at market value.
  • The community right to buy does not force the sale, but only comes into play when an owner decides to sell his or her property.
  • A right to buy petition does not commit the community to the purchase: it only seeks to establish the right to buy. 10% of the community must support the application for it to be valid.
  • The property is valued by a government appointed surveyor, who is entirely independent, and values property at market rates. This guarantees the owner gets a fair price.
  • If the community body decides to activate its right to buy it must carry out a ballot of the community to establish whether the majority of the community wish to go ahead with the purchase.
  • Like the Stronafian Forest vote, only those on the electoral roll are eligible to vote, and 50% of the eligible voters must vote to make the ballot valid. Of that 50% over 50% have to vote in favour for the purchase to go ahead.
  • Even if the ministers grant the community a right to buy on a property the community may decide it is not in its interest to activate that right, and can simply allow the sale of the property to go ahead normally with another party.
  • Often, once a right to buy is established the community and the property owner arrange the sale between themselves without resort to the legislation. This can make the process much shorter.
  • The Community Right to Buy itself lasts for 5 years. If after that period the property hasn’t been put on the market, the community can reapply to have the right extended for a further 5 years. The trust might also decide to let the right lapse and not reapply.

At present the Development Trust is awaiting the minister’s determination on our application to acquire the right to buy on the Glendaruel Hotel. If we are granted a right to buy, and if we decide to move onto the next stage, there will be a thorough and transparent consultation process.

If you have any questions, or are unclear on any points, please don’t hesitate to contact us, we’ll be delighted to hear from you.

Michael Russell MSP welcomes our successful ballot

SNP Parliamentary Candidate for Argyll & Bute, Michael Russell MSP – who lives in Glendaruel –  has given a warm welcome to the vote by local residents which will start the process of community purchase for the Stronafian Forest by the Colintraive and Glendaruel Community Trust.

Mr Russell said:

“As a former Environment Minister as well as a Member of the Trust  I am a strong supporter of community land purchase and particularly the purchase of forests and woodlands by communities.     The ambitious plan by Colintraive and Glendaruel Community Trust to seek to acquire Stronafian Forest and use it as a community resource shows a positive belief by that community in a better and more secure and sustainable  future for the community.   I am therefore delighted that the local ballot of residents has resulted in two thirds backing the plan.

“The community now have 18 months to raise the necessary finance and put in place a sustainable business plan for the forest.   There are a lot of good ideas around and some very positive models elsewhere in Argyll to look at, including the North Mull Forest and the newly purchased woodlands at Kilfinan and on Bute.

“There will be much hard work ahead, but this vote is a vital and very commendable next step in the process.   I am sure the community will get every help and encouragement from the Forestry Commission and from other public bodies as the plans  develop as well as from local business and from local elected representatives.”

It’s a very big YES!

We’re thrilled to announce that the community voted to purchase Stronafian Forest. We’re delighted with this, and have just issued a press release.

Here’s the confirmation of the result as issued by returning officer Shirley MacLeod:

Once we have a positive determination from the NFLS Panel and the Forestry Commission, the work of raising the funds for the purchase will begin. This is a great opportunity for our community and could ensure a sustainable future.

The Ballot Papers for Stronafian Forest Hit the Doormats!

Today I received several reports that the ballot papers and information sheet have been delivered to residents eligible to vote on the acquisition of Stronafian Forest. This marks the next big step in our progress towards owning this valuable community asset and has taken much time to coordinate (well done Rhona!).

We need everyone to vote as getting a 50% return is essential. You should find an SAE in the envelope along with the papers, and if you don’t let us know!

The information we have sent out in this package is available on the publications page.

If you have any queries on the ballot,  the information provided so far or the business plan when it is published let us know via the contact form, phone or email.

Valuation of Stronafian Forest

As announced at the Stronafian Sunday Sandwich, the valuation placed on the subjects is £1.55 million. The full text of the District Valuer’s determination is available here, and includes summaries of both ours and the Forestry Commission’s submissions.

Our view is that this purchase is entirely achievable in the 18 month timeframe we’ll be working to if the community wishes us to buy the woodland.
